Indiana Residency Requirements

In order to file for divorce in the state of Indiana, the petitioner must meet certain Indiana residency requirements. In order to file in an Indiana county the petitioner must be:

  • A resident of the county for three months immediately preceding the filing of the petition for dissolution or marriage; or
  • Stationed at a United States military installation within Indiana for three months immediately preceding the filing of the petition for dissolution or marriage.

Grounds for Divorce

There are four reasons for a divorce that the courts will accept:

  • Irretrievable breakdown of the marriage;
  • The conviction of one of the parties, subsequent to the marriage, of a felony;
  • Impotence, existing at the time of the marriage; and
  • Incurable insanity of either party for a period of at least two (2) years.

Most Indiana divorces cite an irretrievable breakdown of the marriage as the grounds.
